Recognition and Enforcement of Judgments

On 12 July 2022, the Council of Europe has published the decision 2022/2016 in relation to the accession of the Union to the Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters which was concluded under the auspices of the Hague Conference on Private Law. The aim of the Convention is to promote access to justice globally through more enhanced judicial cooperation between its signatory states. This would assist with cross-border litigation and dispute resolution as it would reduce costs and risks relating to such disputes. As a direct result international trade, mobility and investment will be facilitated as it would enable the litigants to take their cases or enforce their judgments easier around the world in all the signatory state territories.

The Council in its decision specifically excludes any non-residential leases (tenancies) of immovable property situated int eh European Union.

The Convention has not yet entered into force in the EU. The specific date shall be published by the General Secretariat of the Council in the Official Journal of the European Union.

On the date of publication of the present six countries have signed the Convention: Costa Rica, Israel, the Russian Federation, Ukraine, the United States of America and Uruguay.
